Terms & Conditions

These Terms & Conditions ("Agreement") are entered into between PT. Pengembangan Jaya Papua ("Company") and the customer ("Customer") for the provision of catering and labor supply services. By engaging the services of the Company, the Customer agrees to abide by the following terms and conditions:

Services Provided:

1. Catering Services: The Company will provide catering services as per the agreed specifications, including menu selection, food preparation, delivery, and setup.
2. Labor Supply: The Company will supply skilled and qualified labor as per the Customer's requirements, subject to availability and applicable regulations.

Booking and Confirmation:

1. Catering Services: The Customer shall provide advance notice for catering services and confirm the booking by paying the required deposit, if applicable.
2. Labor Supply: The Customer shall provide the necessary details regarding labor requirements, including the number of workers needed, duration of service, and any specific skills or qualifications required.

Pricing and Payment:

1. Catering Services: The price for catering services will be determined based on the agreed menu, number of guests, and additional services requested. The Customer shall pay the total amount as per the agreed payment terms.
2. Labor Supply: The price for labor supply will be determined based on the type of labor, duration of service, and any additional requirements. The Customer shall pay the total amount as per the agreed payment terms.

Amendments and Cancellations:

1. Catering Services: Any changes or amendments to the catering order must be communicated to the Company within a reasonable time frame. Cancellations may be subject to cancellation fees as determined by the Company.
2. Labor Supply: Changes to labor requirements must be communicated to the Company in advance. Cancellations may be subject to cancellation fees, especially if the Company has already incurred costs related to recruitment and deployment.

Customer Responsibilities:

1. The Customer shall provide accurate and complete information regarding catering requirements and labor needs.
2. The Customer shall ensure the availability of suitable facilities and utilities for the provision of services, including electricity, water, and cooking equipment, as applicable.
3. The Customer shall comply with all applicable health and safety regulations and provide a safe working environment for the Company's personnel.

Liability and Indemnity:

1. The Company shall exercise reasonable care and skill in providing services. However, the Company shall not be liable for any loss, damage, or injury arising from factors beyond its control or due to the Customer's negligence.
2. The Customer agrees to indemnify and hold the Company and its employees harmless from any claims, damages, or liabilities arising out of the Customer's use of the services provided by the Company.

Confidentiality:

1. Both parties shall maintain the confidentiality of any proprietary or sensitive information disclosed during the provision of services and shall not disclose such information to any third parties without prior written consent.

Governing Law and Jurisdiction:

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Timika, Papua, Indonesia.

Entire Agreement:

This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings, whether written or oral, relating to the subject matter herein.

By engaging the services of PT. Pengembangan Jaya Papua, the Customer acknowledges and agrees to be bound by these Terms & Conditions.
